6. LinkedIn Lead Generation

Operanest may use LinkedIn Lead Gen Forms to allow LinkedIn members to request information, register for content or events, request demonstrations, schedule consultations, or express interest in Operanest products or services.

Depending on the fields used in a campaign, LinkedIn may provide information such as your name, email, work email, phone number, job title, company, company size, industry, location, LinkedIn profile information, or responses to permitted custom questions.

We may use that information to respond to your request, deliver the requested content, register you for an event, evaluate your business needs, schedule a meeting, maintain an appropriate CRM record, follow up regarding Operanest, and send marketing communications where permitted by applicable law and consistent with your choices.

No sale of LinkedIn lead data: Operanest does not sell, rent, trade, or license LinkedIn Lead Gen Form data to unrelated third parties for their independent marketing. Data may be provided to processors, service providers, integrations, or contractors acting on our behalf where reasonably necessary to operate our systems, process the lead, communicate with you, deliver a requested service, or comply with law.

If you ask us to stop marketing to you or to delete eligible information submitted through a LinkedIn Lead Gen Form, we will process the request in accordance with applicable law and valid platform or contractual obligations.

7. Marketing, Email, SMS, WhatsApp, Telephone and Social Media

Where permitted by law, Operanest may communicate by email, telephone, SMS, WhatsApp, social media, or other messaging channels to respond to requests, provide service-related information, follow up on business opportunities, or send relevant marketing communications.

Where consent is legally required, we will rely on appropriate consent. You may opt out of marketing communications at any time. Marketing opt-out does not prevent necessary transactional, account, security, legal, or service communications.

We may use advertising and social media platforms to measure campaign engagement, conversions, audience performance, and attribution, and to conduct retargeting where legally permitted.

8. Artificial Intelligence and Automated Systems

Operanest products may include artificial intelligence, machine learning, automated workflows, conversational systems, voice technology, chat tools, classification, summarization, and routing features. Depending on configuration, these systems may process information to respond to inquiries, route communications, summarize interactions, populate CRM records, schedule appointments, assist support teams, or automate operational workflows.

Where enabled and legally permitted, communications may generate transcripts, summaries, classifications, metadata, or other machine-generated records. Customers remain responsible for ensuring their own use of Operanest's AI and automation capabilities complies with laws applicable to their business and customers.

Where applicable law provides rights related to automated decision-making, eligible individuals may exercise those rights as provided by law.

Marketing and Advertising

Used, where permitted, to measure advertising effectiveness or support relevant advertising.

Where applicable law requires consent before non-essential cookies are used, we will seek that consent as required. You can also control certain cookies through your browser or device settings.

10. Legal Bases for Processing

Where a privacy law requires a legal basis for processing, we may rely on:

  • Consent for processing you have specifically authorized;
  • Contract where processing is necessary to provide requested services or take steps before entering an agreement;
  • Legitimate interests such as B2B relationship management, responding to inquiries, security, fraud prevention, service improvement, and appropriate direct marketing, balanced against your rights;

  • other lawful bases recognized by applicable legislation.

11. How We Disclose Personal Information

Hostecno, LLC may process account, customer-support, subscription, invoicing, payment and related personal information in its capacity as the operator of Operanest. Payment processors and other contracted service providers may process limited information necessary to complete transactions and provide the services.

We may disclose personal information to vendors and service providers that perform functions on our behalf, including hosting, cloud infrastructure, CRM, communications, email, SMS, messaging, payment processing, customer support, scheduling, automation, AI infrastructure, security, analytics, and advertising measurement.

We may also disclose information where required by law, valid legal process, a legitimate security investigation, fraud prevention, protection of rights or safety, or in connection with a merger, financing, reorganization, acquisition, or sale of business assets, subject to applicable law.

12. No Sale of Personal Information

Operanest's business model is not based on selling personal information. We do not sell contact lists, rent lead databases, or provide customer or prospect data to data brokers for payment.

We do not sell LinkedIn Lead Gen Form data.

Some privacy laws define "sale," "sharing," or targeted advertising more broadly than ordinary language. If a particular advertising technology is legally treated as sharing or targeted advertising, eligible individuals may exercise applicable opt-out rights as required by law.

13. International Data Transfers

Operanest may work with customers, infrastructure, vendors, and service providers located in multiple countries. Personal information may therefore be processed outside the country in which it was collected.

Where applicable law requires safeguards for international transfers, Operanest will use appropriate contractual or other legally recognized mechanisms reasonably available for the relevant transfer.

14. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, managing leads and customer relationships, maintaining appropriate business records, resolving disputes, enforcing agreements, complying with legal obligations, and protecting against fraud or abuse.

Retention periods vary based on the type of information, why it was collected, whether an active account or sales opportunity exists, legal requirements, contractual requirements, and valid privacy requests. When information is no longer reasonably required, it may be deleted, anonymized, aggregated, or securely disposed of, subject to legal and technical limitations.

15. Data Security

Operanest uses reasonable administrative, technical, organizational, and physical measures designed to protect personal information against unauthorized access, misuse, disclosure, loss, alteration, or destruction.

No website, network, database, transmission method, or storage system can be guaranteed to be completely secure. Users are also responsible for protecting passwords, credentials, devices, and account access under their control.
